On rehearing the Court was satisfied beyond reasonable doubt that excessive water ingress and significant dewatering from the site occurred and that, although the precise mechanism could not be positively identified, the only reasonable and irresistible inference on the proved facts was that the manner in which the ELS works were carried out caused the formation of the sinkhole; accordingly the prosecution proved causation for the strict liability offence and the convictions were upheld.
