The court exercised its discretion to award costs to the petitioner because the petitioner was a genuine creditor by subrogation and entitled to seek winding up, the strike-out summons lacked sufficient merit on the affidavit evidence, subsequent events did not render the summons academic, and the withdrawal appeared strategic; accordingly Yuen must pay the petitioner's costs including the costs of the argument on costs.
