Non-disclosure by the prosecution of contemporaneous statements by prosecution witnesses that materially contradicted their trial testimony constituted a sufficiently serious departure from the duty of disclosure, undermined the credibility assessment and rendered the conviction unsafe; accordingly the conviction must be quashed for substantial and grave injustice.
