The Court held the videotaped statement of A1 was admissible and voluntary; convictions premised on apprentice jockeys being public servants were unsustainable after the CFA authority but, on the evidence including indenture agreements, the apprentices were agents of their trainers and s83A permitted substitution of convictions on the alternative agent-based charges; the factual evidence was sufficient to support the conspiracy and related convictions; original sentencing was appropriate and unchanged.
