The trust property consisted of funds originally donated for the specific charitable purpose of locating, returning and providing for the burial and repose of souls of Pon Yup natives dying abroad; that purpose is charitable (In re Hetherington) so the property is held on charitable trust, the 1st defendant is not entitled to the property for its general purposes, and because the particular purpose has failed the court must direct a cy-pres scheme to apply the funds.
