On the evidence the unclaimed shares and cash balances are held by the applicant as trustee and section 104 of the Trustee Ordinance imposes a mandatory duty to pay such unclaimed trust assets into court in accordance with section 62; accordingly the originating summons was granted and payment into court ordered, with the applicant's costs to be paid out of the unclaimed assets before the balance is paid into court.
