The Court dismissed the application to strike out and held that an appeal lies against an order granting a stay of proceedings in favour of arbitration despite the existence of prior O.14 proceedings that resulted in unconditional leave to defend; s.14(3)(b) does not deprive a litigant of the right to appeal a stay order in these circumstances.
