Leave of the court is required to serve an originating summons out of the jurisdiction when the relief sought is in the court's wardship jurisdiction because Hong Kong legislation does not specifically empower the High Court to hear and determine wardship claims against persons outside the jurisdiction; Order 11 r.1(2)(b) requires such specific statutory enabling language which is absent for wardship.
