The court found the defendant's account of two oral agreements credible and the plaintiff not credible; occupation was by consent under the second oral agreement until April 2010, therefore adverse possession did not mature and the limitation period had not expired when the defendant filed his counterclaim in February 2018; accordingly the plaintiff's action was dismissed and judgment entered for the defendant for possession and mesne profit.
