The court held that the statute's wording must be given its plain meaning and that a fixed three-year tenancy which gives the tenant alone an option to determine earlier does not fall within the statutory exclusion in s.2(2)(a); accordingly the application for review by the landlord was refused and the Ordinance applies to such a tenancy.
