The 2.75% additional sum in the Supplemental Agreement is payable only on the aggregate amount of monthly instalments that were outstanding (i.e. due) at the date of termination, not on future instalments for the unexpired term; the contract balance did not become due until damages were crystallised and assessed. Accordingly the plaintiff was entitled to assessed further damages of HK$429,625.65.
