Court accepted defendants' evidence and contemporaneous documentary evidence that (a) artefacts in the Pacific Flat were gifted to the 1st Defendant (or held such that survivorship made her sole owner on death) and therefore did not form part of the deceased's estate; (b) artefacts in the Shanghai Flat were transferred with the Shanghai Flat to the 2nd Defendant and her sister and thus were not estate assets; and (c) the JPY3,000,000 paid by AEC was properly received by the 2nd Defendant under a tripartite arrangement/equitable assignment following the deceased's transfer of his business.
