- Court
- Court of First Instance
- Case number
- HCMA109/2007
Convictions were upheld because defence counsel's lack of objection to production of key documents at trial precluded a successful appellate challenge, PW1's direct evidence independently established that the misrepresentations operated on her mind and induced payment, and any hearsay infirmity in PW4's evidence would not have altered the outcome; however the magistrate had erred in sentence starting point and in taking the appellant's police status as an aggravating factor without nexus, so the court substituted concurrent sentences of seven weeks imprisonment (totality seven weeks).
