Section 67A(1A) precludes discount for administrative detentions unrelated to the offence; the Magistrate reasonably adopted a 12‑month starting point for going equipped for stealing and was correct not to discount the appellant's prior unrelated administrative detention, therefore the appeal is dismissed and the sentence is affirmed.

The magistrate, having personally heard the witnesses and assessed credibility, was entitled to reject the appellant's account as inherently improbable and to accept the police evidence that the appellant entered the construction site and attempted to climb the fence while in possession of tools; the fresh photographs did not undermine those findings, therefore the conviction was safe.

A chopper did not fall within s27(1) as an article for use in connection with burglary, theft or cheat and therefore the defendant was not guilty of going equipped; moreover, the Crown was entitled to call rebuttal evidence once the receipts were produced in the defence case because receipts were not before the court until produced and became a matter in issue at that time, permitting rebuttal evidence notwithstanding the prosecution's prior knowledge that such receipts might be relied on.
