Because the complainant knew the appellant the magistrate was not required to apply the special caution applicable to first-time dock identification of strangers; and because s.32 of the Theft Ordinance and authority (Machent v Quinn) permit conviction for theft of any one of the items alleged without requiring amendment under s.27, the conviction for theft of the notebook was valid and the appeal must be dismissed.
