The appeal is dismissed because the deputy magistrate properly considered relevant mitigating and aggravating factors, applied correct sentencing principles, and the 6 months' imprisonment sentence for theft was not excessive in light of the deliberate nature of the intrusion and the appellant's record of dishonesty.

The appeal was dismissed because the appellant, having been convicted and sentenced in the Magistrates' Court, failed to attend the hearing in the Court of First Instance and no submissions or grounds were presented to displace the conviction; the court therefore exercised its discretion to dismiss the appeal.

The appeal was allowed and the conviction quashed because the magistrate improperly curtailed defence cross-examination of the prosecution's critical witness regarding his signed Shop Theft Statement pro forma, thereby depriving the defence of the opportunity to expose material inconsistencies on a matter central to credibility and sequence of events; that defect rendered the conviction unsafe. Other grounds were rejected as lacking merit and the trial judge was entitled to prefer PW1's evidence and to reject aspects of the psychiatric opinion.
