The Court of Appeal held that the contractor's claims for indemnity arising from negligence of the contractor's own employee fell outside the scope of the subcontractor's employees' compensation policy; while the phrase 'and his contractors' can sensibly be read to include principal contractors for the purpose of risks created by section 24 of the Employees' Compensation Ordinance, it does not extend cover to indemnify the contractor for its vicarious liability for its own employee's negligence; accordingly the appeal is allowed and the judgment below is set aside.
