The father failed to prove the alleged express 4‑Parties Agreement or particularised conduct sufficient to infer a common intention or trust; the evidence supports that the disputed assets were gifts to the wife and therefore form part of the matrimonial pot; accordingly the father's third‑party ownership claim is dismissed and ancillary relief is granted to the wife—a lump sum of HKD 5,100,000 secured by the Shares and monthly child maintenance of HKD 72,000.
