On an objective view of the circumstances the court found Innova was the buyer because Innova was to pay the Plaintiff directly and to pay the Defendant only the shirt price less the fabric; therefore there was no sale of the fabric to the Defendant and the Plaintiff could not recover the price from the Defendant.
