The Court has jurisdiction to grant an anti-suit injunction as an interim measure under section 45 of the Arbitration Ordinance (and/or section 21L of the High Court Ordinance) to enforce the negative promise to arbitrate where there is a serious issue to be tried and where granting the injunction preserves the status quo and prevents prejudice to the arbitral process; accordingly an interim injunction restraining the Defendant from pursuing Mainland proceedings was justified pending the substantive hearing of the originating summons.
