On the balance of probabilities the court found the accident was caused by the contractor's placement/operation of the Signboard in conjunction with live Traffic Lights which created a traffic hazard; the Defendant reacted promptly and was not negligent; the Plaintiff brought its vehicle to a complete halt lawfully; accordingly both the Plaintiff's claim and Defendant's counterclaim were dismissed and damages were not awarded.
