The court found that on the evidence and submissions the respondent satisfied the NSL s42(2) first threshold (sufficient grounds to believe he will not continue to commit acts endangering national security) and, applying the Criminal Procedure Ordinance, did not pose unacceptable risks of reoffending or absconding; accordingly bail should be maintained on the terms ordered by the Chief Magistrate and the Secretary for Justice's review application is refused.
