The court held that 'first discovery' occurred when the SEHK report and accompanying letter dated 22 October 1997 were delivered to the SFC and disclosed the material facts such that the prosecutor could apply his mind; accordingly the one year period commenced from that delivery and the information laid on 2 November 1998 was outside the 12 month period, rendering the prosecution time-barred and the conviction unsustainable.
