The contractual references to an "occupation permit" in the standard sale agreements must, in the factual and statutory context of Regency Court (Small House Policy exemption), be read to mean the government document permitting lawful occupation (Certificate of Compliance); issuance of the Certificate of Compliance satisfied clause 9 and extinguished purchasers' claims of repudiation; purchasers were therefore in breach and vendor entitled to damages; challenges based on Building Licence conditions and title failed.
