The court was satisfied that the requirements of s12A were met because the mortgage was of record with no evidence of redemption, reasonable and specific steps were taken to locate the mortgagee or successors and they could not be found, and the proposed sum of HK$3,600 was an appropriate amount to be paid into court to redeem the 1937 mortgage; accordingly the court directed payment into court and ordered procedural steps (advertisement, opportunity to apply to be joined, and subsequent paper application for declaration).
