The court was satisfied there was cogent and compelling evidence that the plaintiff was defrauded and that the narrowly defined documents sought were highly germane to identifying the defendant and tracing funds; disclosure was likely to produce substantial benefit to preserve or recover the plaintiff's assets, the bank adopted a neutral stance and raised no objection, and on balancing confidentiality/privacy concerns the scales favored disclosure; accordingly an order for disclosure under s21 EO and/or Norwich Pharmacal was granted with an amended costs provision.
