Uncontroverted evidence established the plaintiff was the victim of email fraud and the misappropriated sums were traceable as the last transactions into the defendant's frozen account; the court has jurisdiction under s52(1)(e) Trustee Ordinance to make a vesting order in such constructive trust cases and it is expedient to do so; accordingly declaratory relief and a vesting order were granted and final judgment entered for the plaintiff.
