There was a good arguable case that the defendants' combination and communications were arguably calculated to injure the plaintiff and the proposed survey was likely to damage the plaintiff's business; the trial judge properly exercised his discretion under American Cyanamid and, on the balance of convenience (including difficulty of quantifying damages), the interlocutory injunction should be continued; the appeal is therefore dismissed.
