On the totality of documentary and official evidence — historical assignments naming the deceased, the Waiver Letter addressed to and signed by him personally, inclusion of the lands in the probate schedule with estate duty paid, the executors' statutory declaration and absence of business registration — the court concluded Yau Loong Preserved Ginger Factory was a trade name of the deceased and not a distinct legal entity; therefore the plaintiffs were entitled to the declarations sought enabling registration of the Four Assignments.
