Leave to appeal was refused because none of the applicant's complaints constituted a reasonably arguable ground of appeal: the mobile phone was lawfully seized and its contents admissible (and the applicant had previously asserted he gave the passcode); the counsel's correction of a transcript was not an admission under s65C; the alleged eyewitness was unidentified and a tactical non-call by defence cannot found an appeal; accordingly the judge's rulings and the sufficiency of the prosecution case did not give rise to a prima facie ground of appeal.
