Section 66(5) of the PDPO is a procedural venue provision requiring s.66(1) claims to be brought in the District Court but does not oust the inherent jurisdiction of the Court of First Instance under s.3 HCO; accordingly the CFI has jurisdiction to hear s.66(1) claims and the District Court may transfer the action to the CFI under s.42 DCO where justice and efficiency so require; on the facts the two proceedings arise from the same transaction and transfer to the CFI was appropriate.
