Leave to appeal was refused because none of the grounds raised had reasonable prospects of success: the court's evaluation of competing expert translations and factual findings on hearsay and credibility were not undermined; the defendants had demonstrated credible defences and had not submitted to Hong Kong jurisdiction; accordingly the stay in favour of the Pudong New District People’s Court stands and indemnity costs were appropriate given the plaintiff commenced proceedings in breach of an exclusive jurisdiction clause.
