The court refused to treat the pleaded breaches of s.34I BMO and the DMC as viable causes of action against defendants who are not co-owners, and found trespass was not pleaded; accordingly default judgment could not be entered on the pleaded case and the plaintiffs were permitted to withdraw the application with no order as to costs.
