On the evidence the Property was acquired and held as a collective undertaking for the unincorporated society with the registered owners acting as nominees; membership continuity upon incorporation vested the beneficial interest in the Applicant; three nominees are deceased and the other two are untraceable such that the statutory uncertainty threshold in s45 Trustee Ordinance is met; accordingly a vesting order and declaration of beneficial ownership in favor of the Applicant were appropriate and ordered.
