On the evidence the court found that Jennifer was the sole beneficial owner of the monies in the UBS account and of the Estate Management Funds, that the 2006 transfers of YSC and Haw Yuet shares were gifts/transfers consistent with Mother’s intention (with Jennifer holding certain shares on trust for Raymond and Victor as found), and that the plaintiff’s case on the SHETC dividends was unpleaded; accordingly the plaintiff’s proprietary and fiduciary claims failed and the action was dismissed.
