The Court held the judge did not err in finding that TTE had an arguable case of beneficial ownership and misappropriation such that joinder under Order 15 r 6(2)(b)(i) and (ii) was justified, and that the judge properly exercised his discretion to order joinder; there was no reasonable prospect of success on the proposed grounds of appeal, so leave to appeal was refused and related summonses to adduce evidence or amend the notice were dismissed.
