On the facts the Plaintiff had exclusive factual possession and the requisite intention to possess the Property from the Father’s death on 3 February 2004; more than 12 years elapsed by the Originating Summons so the beneficial owners’ rights to recover the Property were time-barred and their titles extinguished under section 17 Limitation Ordinance; accordingly the court granted the declaration of extinguishment and made no order as to costs.
