Because Cheng materially failed to disclose multiple facts highly relevant to the discretionary weighing exercise (notably his intimate relationship with the 1st Defendant, inconsistencies with prior pleadings and proceedings, and disputed account balances), the court was not satisfied there was a strong prima facie case of fraud and therefore discharged the ex parte Mareva injunction and refused to regrant it.
