The court held that there was no clear and unequivocal renunciation by the plaintiff and therefore no anticipatory breach the defendant could validly accept; further, an occupation permit was not necessary to establish title for this pre-1956 building and, even if enforcement powers under earlier law were arguable, there was no real risk of successful enforcement action. Accordingly the defendant wrongfully repudiated the Agreement and the plaintiff was entitled to the declarations and relief sought.
