Although the applicant holds the specified sums on trust, it failed to demonstrate that it had exhausted all reasonable means to return the funds or that continuing to hold them was impracticable or unduly burdensome; accordingly the court declined to exercise its discretion under s62 to permit payment into court and dismissed the originating summons.
