The specified items of cash were held by the applicant as trustee for the 62 unclaimed clients; the court granted leave to pay HK$108,285.90 into court and ordered that notice by advertisement and letters to last known addresses within 7 days would satisfy Order 92 r4; no order as to costs.

Because the client agreements and factual conduct established an agency/trust relationship and the applicant demonstrated reasonable and repeated efforts to notify the two clients, the court granted a declaration that the monies are held as trustee and gave the applicant leave to pay the unclaimed monies into court, subject to specified notification and procedural requirements and treatment under surplus fund rules.

Having found the applicant held the listed client monies on trust and having accepted the applicant had given termination notices, further notices and attempted contact, the court granted declarations and ordered payment of the unclaimed monies into court and directed advertisement and letters under Order 92, deeming O.92 r.4 complied with upon compliance with the order.
