The indemnity cost provision in the standard form credit card agreements was unconscionable within the meaning of the Unconscionable Contracts Ordinance given unequal bargaining power, lack of notice, extreme breadth and absence of limits on recoverable charges; accordingly the clause was unenforceable and plaintiffs were limited to the fixed costs set out in the Rules; appeal dismissed.
