Leave to appeal was refused because the proposed 'fetter' question did not genuinely raise a question of law of great general or public importance, the exercise of discretion to refuse a stay/anti-suit injunction in the circumstances was within acceptable range (given non-party respondents, limited scope of exclusive jurisdiction clauses, jurisdictional tangle and lack of effective remedy in England), and therefore no basis to interfere with the lower courts' discretionary decisions.
