Where two charges arise from the same act of unlawful presence in breach of a deportation order, sentences should not be wholly consecutive; sentencing must start from recognition of the common underlying culpability and can appropriately make part concurrent and part consecutive to reflect additional culpability; accordingly the first sentence was varied to 15 months and the aggregate fixed at 18 months by ordering three months of the second sentence consecutive to the first.
