The appellate court found no error in the Magistrate's exercise of sentencing discretion: the Magistrate considered the appellant's circumstances, applied the guilty plea discount, and appropriately treated the victim's young age and the appellant's knowledge of it as an aggravating factor; therefore there was no basis to interfere with the six months' imprisonment sentence.

The sentencing judge lawfully considered the appellant's long acquaintance with the victim, the course of conduct, the victim's ordeal at trial and prior convictions; given the maximum statutory penalty and the circumstances, a two-year concurrent sentence was not excessive and the application for leave to appeal was properly refused.

Although the trial judge's reasons were elliptical and could have been clearer about corroboration, the Court was satisfied the judge had the danger warning in mind and nonetheless accepted the complainant's evidence to the required criminal standard; accordingly there was no misdirection and the convictions stand.
