Because the appellant amended its notice and filed new reply evidence after the respondents’ evidence was filed, and because fairness required respondents a proper opportunity to answer those new grounds, the court found exceptional circumstances under the relevant rules and case law to justify moving the milestone date; accordingly the respondents were permitted limited additional time to finalise and file evidence and the court will hear counsel on and then make directions as to new dates.
