Although the magistrate had made sufficient enquiries into means, he erred in assessing the level of the fines by effectively treating the bail deposits as indicative of the appellant's ability to pay; fines were excessive in light of appellant's lack of legitimate income and risk of borrowings so appeal allowed in part and fines reduced to HK$5,000 in each case while custodial sentences were affirmed.
