Defendants failed to prove on the balance of probabilities the existence of the alleged Agreed Fee Arrangement; contemporaneous documents (including trustee certificates submitted for taxation) and inconsistent versions of the alleged arrangement undermined defendants' case. Consequently the Revised (taxed) bill and the taxing fee were payable and judgment was entered for plaintiffs for HK$2,244,578.52 with interest and costs, and defendants' alternative arguments about client funds and funding agreements did not defeat the primary liability.
