The Court held that despite strong and repeated judicial comment and some overstatement about police competence, the summing-up did not render the trial unfair or the conviction on count 2 unsafe; the judge was entitled to ask the accused relevant questions, to warn the jury that prior statements/notebook entries are not evidence but may affect credibility, and overall the jury's verdict on count 2 is upheld.
