Imprisonment was inappropriate where the offender's offending was driven by a diagnosed mental condition (dysthymia), custodial sentences cannot validly be conditional on receiving psychological treatment, and a probation order with specific supervisory and treatment conditions was the proper and available alternative; accordingly the appellate court reversed the immediate sentence and substituted a two-year probation order with treatment conditions.
